We do not make lending decisions, issue funds, set interest rates, or determine repayment terms. All funding decisions are made exclusively by direct lenders on our platform.
Submitting false, misleading, or fraudulent information through AI MCA Exchange is strictly prohibited and may constitute fraud under applicable law.
You represent and warrant that all information you provide — including business information, financial statements, bank statements, revenue figures, and identity documents — is accurate, complete, and not misleading in any material respect. Submitting falsified documents may constitute bank fraud and wire fraud under federal law.
AI MCA Exchange is completely free for merchants. You will never be charged a fee to use our platform, access your AI agent, submit your file, or receive funding offers.
Our platform is funded by fees paid by direct lenders. These fees are paid by lenders — never by merchants. Any fees associated with a specific funding product are set entirely by the direct lender and disclosed to you in the offer.
All content, features, functionality, design, code, trademarks, logos, and materials on the AI MCA Exchange platform are the exclusive property of SJM AND SON INC DBA AI MCA Exchange and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the platform solely for your personal business funding purposes.
The platform is provided “as is” and “as available” without warranties of any kind, express or implied.
Nothing on this platform constitutes financial, legal, tax, or investment advice. You should consult appropriate professionals before entering into any financial agreement.
To the maximum extent permitted by applicable law, SJM AND SON INC DBA AI MCA Exchange and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability to you for any claim shall not exceed the amount you paid to us in the twelve months preceding the claim.
You agree to defend, indemnify, and hold harmless SJM AND SON INC DBA AI MCA Exchange and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses arising from your use of the platform in violation of these Terms, your submission of false or fraudulent information, or your violation of any applicable law.

Our right to terminate: We reserve the right to suspend or terminate your account at any time if you have violated these Terms, submitted fraudulent information, or engaged in activity that threatens the integrity of our platform.
These Terms are governed by the laws of the United States and the state in which SJM AND SON INC DBA AI MCA Exchange is registered, without regard to conflict of law provisions.
Informal resolution first: Contact us at hello@mcaexchange.ai before initiating any formal legal proceeding. We will make a good faith effort to resolve any dispute within 30 days.
Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association on an individual basis — class action proceedings are not permitted.
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email and post a prominent notice at least 30 days before the changes take effect. We will never use a Terms update to retroactively impose fees on merchants.
Program Description: SJM AND SON INC DBA AI MCA Exchange operates an SMS messaging program to communicate with merchants who have opted in to receive text messages. By providing your mobile phone number and checking the SMS consent box during registration, you consent to receive text messages from SJM AND SON INC DBA AI MCA Exchange at the number provided. This is a transactional and account-notification program — not a marketing program.

Message Frequency: Message frequency varies based on your application activity and account status. You may receive up to several messages per week during active application periods.
Message & Data Rates May Apply. Standard message and data rates may apply depending on your mobile carrier plan. SJM AND SON INC DBA AI MCA Exchange is not responsible for any charges incurred by your mobile carrier in connection with SMS messages sent under this program.
How to Opt Out: You may opt out of SMS messages at any time by replying STOP to any message you receive from us. After texting STOP, you will receive one final confirmation message and no further messages will be sent to that number. SJM AND SON INC DBA AI MCA Exchange and participating carriers including AT&T, T-Mobile, Verizon, Sprint, Boost, and MetroPCS are not responsible for any delays, failures, or misdirected delivery of any SMS message or its content.
Supported Carriers: Compatible U.S. carriers include AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, MetroPCS, U.S. Cellular, and other major and regional carriers.
Consent Not Required for Purchase: Consent to receive SMS messages is not a condition of obtaining funding or using any services offered by SJM AND SON INC DBA AI MCA Exchange.
